These Terms of Service ("Terms") are a legal agreement between you and Outpaint.co.uk ("Outpaint", "we", "us", "our") governing your use of our website and image-outpainting service (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

(Placeholder — fill in before launch: UK consumer and company law require traders using a business name to display the proprietor's own name and a UK address for service.)
Your statutory rights. Nothing in these Terms limits or excludes any consumer rights that cannot by law be waived or limited, including your rights under the Consumer Rights Act 2015 in relation to digital content. Where anything in these Terms conflicts with those rights, your statutory rights win.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service. By using it, you confirm that you meet these requirements.
2. The Service
Outpaint uses AI to extend ("outpaint") the area around an image you upload — adding background and adjusting it to a target resolution — while aiming to preserve your original subject. A free non-AI "stretch to fill" resize mode is also offered. The Service depends on third-party AI models and may change, improve, or vary over time. Usage allowances, rate limits and free-tier limits are operational controls, not fixed entitlements — we may adjust them to keep the Service stable and prevent abuse.
3. Your content and the rights you grant
- You keep ownership of the images you upload and, as between you and us, of the output generated from them.
- You grant us a limited licence to process, transmit, modify and store your image and its output only as needed to provide the Service (including sending it to our AI sub-processors and running the safety checks described in section 5). This licence ends when processing is complete, except that we retain the non-image metadata described in our Privacy Policy (such as a numeric fingerprint of the output and content-safety records) and anything we must keep to comply with law.
- You warrant that you have the rights to every image you upload — that you own it or have permission to use it, and that processing it does not infringe anyone's copyright, trademark, privacy, publicity or other rights. If your image shows identifiable people, you are responsible for having any consent the law requires.
4. Acceptable use — prohibited content and conduct
You must not upload, generate, or attempt to generate, or use the Service for, any of the following:
- Any content that is unlawful under the laws of England and Wales or your jurisdiction.
- Child sexual abuse material (CSAM) or any sexual content involving minors — zero tolerance. We will preserve relevant information and report suspected CSAM to law enforcement and the relevant authorities (e.g. the Internet Watch Foundation / NCA), and permanently ban the user.
- Intimate or sexual imagery of any real person without their consent — including using outpainting to create, extend or alter an image so that a real, identifiable person appears in an intimate or sexualised way. Creating or requesting such an image is a criminal offence in the UK (Sexual Offences Act 2003, as amended), and we will report it.
- Images of real, identifiable people created or altered to deceive, defame, harass, impersonate, or place them in a false or compromising context (including misleading "deepfakes").
- Content that infringes any third party's intellectual property or other rights.
- Content that is hateful, harassing, threatening, or that incites violence or discrimination.
- Content that depicts or promotes terrorism, extreme violence, or serious self-harm.
- Any attempt to bypass, disable or defeat safety filters, moderation, rate limits, or security measures.
- Accessing the Service through automated means (scraping, bots, bulk API-style use) beyond normal personal use, or mirroring or framing the Service.
- Using the Service, or the output it generates, to train, develop or improve any machine-learning or AI model, or for any facial-recognition or biometric-identification purpose.
- Reselling, redistributing or commercially exploiting the Service itself (as opposed to your own output) without our written permission.
You are solely responsible for the images you upload and how you use the output. We may refuse, remove, or stop processing any content, and suspend or terminate access, where we reasonably believe these Terms have been breached — see section 5 for how automated moderation and suspension work.
5. Content moderation, blocking and suspension
- Every upload and every generated image is automatically safety-screened before a result is delivered. We may block your upload, or decline to deliver a generated result, where the screening flags it or where it cannot be safety-checked. We screen automatically but are not obliged to pre-screen, and blocking is at our reasonable discretion.
- If a paid transform is blocked by moderation, your payment is refunded automatically. You will never be charged for a result we refuse to deliver.
- Repeated moderation blocks lead to automated suspension of your session pending review. If you believe a suspension is wrong, email support@outpaint.co.uk: you may make representations, and a human with authority to overturn the decision will review it.
- We may preserve and disclose content or activity to law enforcement or other authorities where we reasonably believe it is unlawful or where the law requires us to.
6. AI-generated output — important information
- AI output is probabilistic and can make mistakes. We do not verify the accuracy of output, and we do not promise that output will be realistic, seamless, error-free, or suited to any particular purpose. This does not limit your statutory rights where digital content is faulty (see the Refund Policy).
- Output may not be unique. Similar or identical output may be generated for other users, and your ownership of your output does not extend to other users' independently generated output.
- No guarantee on rights in output. AI-generated content may not be protectable by copyright, and we make no warranty that output does not infringe third-party rights. You are responsible for checking before commercial use.
- Unexpected or inappropriate output. Despite our safety measures, AI systems can occasionally produce unintended, distorted, offensive, or otherwise inappropriate results. You must review all output before using or publishing it.
- Output is generated automatically without human review of its content. It does not represent our views.
7. Payments, price and cancellation
- Paid transforms cost £1.50 GBP each, total — no further charges from us. The price shown at checkout when you pay is the price that applies to that purchase. If your card is not in GBP, your bank may apply its own currency-conversion fees. Payments are processed by Stripe; by paying you also agree to Stripe's terms.
- Immediate delivery and your cancellation right. Your transform is generated and delivered immediately. At checkout you expressly consent to immediate supply and acknowledge that you lose the 14-day right to cancel under the Consumer Contracts Regulations 2013 once processing begins. This never affects your rights if the content is faulty.
- A free allowance may be offered and may be changed or withdrawn at any time; free transforms are provided without charge and carry no entitlement to continued availability.
- If you choose "store details for future use", your payment details are saved by Stripe (we hold only an encrypted reference) and you can ask us to delete them at any time.
- Refunds are governed by our Refund Policy. Please contact us before raising a chargeback — unwarranted chargebacks may lead to suspension of access, though this never limits your statutory rights or legitimate disputes.
8. Service failures
If a paid transform fails to produce a usable result due to a technical fault on our side, or is blocked by our safety screening, your remedy is set out in the Refund Policy (an automatic refund for moderation blocks; a re-run or refund for technical faults). Dissatisfaction with the creative outcome of a technically successful transform is addressed there too.
9. Availability and changes to the Service
We aim to keep the Service available but do not guarantee that it will be uninterrupted, timely, or error-free. We may change, suspend, or discontinue any part of the Service (including the underlying AI models), and may introduce features on a beta or experimental basis which are supplied with reasonable care but without any promise of continued availability. None of this affects purchases already made or your statutory rights in relation to them.
10. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for damage to your device or other digital content caused by digital content we supply without reasonable care and skill (Consumer Rights Act 2015, s.46), or for any other liability that cannot be excluded or limited under English law — including your statutory rights and remedies as a consumer in relation to digital content.
Subject to that:
- We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill, or anticipated savings.
- We are not liable for loss or damage arising from your content, your use of the output, or your breach of these Terms.
- Our total aggregate liability to you arising out of or in connection with the Service is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) £100. This cap does not apply to the liabilities listed in the first paragraph of this section.
11. Indemnity
If you use the Service in breach of these Terms and that breach causes a third party to bring a claim against us, you agree to compensate us for the losses, liabilities and reasonable costs (including reasonable legal fees) that result. This applies to claims arising from your content, your use of the output, or your violation of law or third-party rights — not to claims caused by our own fault.
12. Reporting content and IP complaints
If you believe content processed through the Service infringes your rights (including copyright) or is illegal, email support@outpaint.co.uk with enough detail to identify the content and your interest in it. We review reports promptly and take appropriate action, which may include blocking content and suspending or banning users.
13. Feedback
If you send us ideas, suggestions or feedback about the Service, you agree we may use them without restriction or compensation, and that they are provided on a non-confidential basis.
14. Suspension and termination
We may suspend or terminate your access immediately if you breach these Terms, misuse the Service, or where required by law (automated suspensions are described in section 5, including your right to a human review). Sections that by their nature should survive termination (including content warranties, disclaimers, liability limits and indemnity) will continue to apply.
15. Third-party services
The Service relies on third parties including Stripe (payments), Replicate / Black Forest Labs and OpenAI (AI processing and safety screening), Supabase and Upstash (infrastructure), Cloudflare (bot protection), and Vercel and IONOS (hosting). We choose and contract with these providers with reasonable care, but we are not responsible for their independent acts or terms.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows the latest version, and material changes will be highlighted on the site. The version of these Terms in force when you make a purchase is the version that applies to that purchase.
17. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales. Nothing in these Terms affects your mandatory statutory rights as a consumer, including any mandatory consumer-protection rights you have under the law of the country in which you are resident, where applicable, or your right to bring proceedings in your local courts where the law gives you that right.
